DMCA Policy

Sun Dried Tomato Pesto (referred to as "we", "our", or "us") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the Sun Dried Tomato Pesto website or other online network that are reported to our Designated Copyright Agent.

Filing a DMCA Takedown Notice

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through our website by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent. Upon receipt of the Notice as described below, Sun Dried Tomato Pesto will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Site.

  1. Identification of the copyrighted work claimed to have been infringed: Provide sufficient detail to enable us to locate the copyrighted work, or provide a link to the original copyrighted work. If multiple copyrighted works are covered by a single notification, provide a representative list of such works.
  2. Identification of the material that is claimed to be infringing: Provide information reasonably sufficient to permit us to locate the material (e.g., URL(s) where the infringing material is located).
  3. Contact information for the complaining party: Include your full legal name, mailing address, telephone number, and email address.
  4. A statement that the complaining party has a good faith belief: State that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notice is accurate: State that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. An electronic or physical signature: Provide your electronic or physical signature (typing your full legal name will suffice for an electronic signature).

Filing a DMCA Counter-Notification

If you believe that the material you posted on the Sun Dried Tomato Pesto website was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us by submitting written notification to our Designated Copyright Agent. Pursuant to Sections 512(g)(2) and (3) of the DMCA, the counter-notification must include substantially the following:

  • Identification of the material that has been removed or to which access has been disabled: Describe the material and provide the URL(s) or other identifying information of the material before it was removed or disabled.
  • A statement under penalty of perjury that the subscriber has a good faith belief: State that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Subscriber’s name, address, and telephone number: Include your full legal name, mailing address, and telephone number.
  • A statement that the subscriber consents to the jurisdiction: State that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which Sun Dried Tomato Pesto may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • An electronic or physical signature: Provide your electronic or physical signature (typing your full legal name will suffice for an electronic signature).
